TERMS OF SERVICE.

These Terms of Service ("Terms") govern your access to and use of the websites, applications, content, recordings, audiovisual works and other services made available by Evergreen Empire LTD ("Evergreen Empire", "we", "us" or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you must not use the services.

All recordings, compositions, lyrics, artwork, photographs, videos, logos, trade marks, designs and other materials made available through our services are owned by Evergreen Empire, our artists, our licensors or our partners, and are protected by copyright, trade mark and other intellectual property laws.

Except for the limited rights expressly granted in these Terms, no right, title or interest in any of our content is transferred to you. You may not reproduce, distribute, modify, publicly perform, publicly display, create derivative works of, sell, rent, lend or otherwise commercially exploit our content without our prior written consent.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our services for personal, non-commercial purposes. Any other use, including data mining, scraping, indexing, or use of our content to train artificial intelligence or machine learning models, is strictly prohibited without our prior written authorisation.

If you submit demos, recordings, ideas, materials or any other content to Evergreen Empire, you represent and warrant that you own or control all necessary rights in such submissions and that they do not infringe the rights of any third party. We are under no obligation to review, return or compensate you for unsolicited submissions.

You agree not to use our services to: violate any applicable law or regulation; infringe the intellectual property, privacy or other rights of any person; upload or transmit malicious code; interfere with the security or integrity of the services; impersonate any person or entity; or engage in any activity that is harmful, fraudulent or otherwise objectionable.

Our services may contain links to, or be integrated with, third-party platforms including streaming services, social networks, ticketing providers and analytics tools. We are not responsible for the content, policies or practices of any third party, and your use of such services is governed by their own terms.

To the fullest extent permitted by law, our services and content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

To the fullest extent permitted by law, Evergreen Empire, its affiliates, officers, directors, employees, artists and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to your use of, or inability to use, the services.

You agree to indemnify and hold harmless Evergreen Empire and its affiliates from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or related to your use of the services, your submissions, or your violation of these Terms.

We may suspend or terminate your access to the services at any time, with or without notice, for any reason, including any breach of these Terms. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability and dispute resolution.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Evergreen Empire LTD is established, without regard to its conflict of law principles. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute arising out of or relating to these Terms.

We may modify these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Your continued use of the services after such changes constitutes your acceptance of the revised Terms.
